Employer Nomination Scheme (subclass 186)

Direct entry stream: The employer is required to demonstrate that there is a genuine need to fill the nominated position for at least two years post visa grant, and that the salary paid is at least what an Australian would be paid in that role.

Temporary Residence Transition Stream: the employer demonstrates the above as well as demonstrate that the nominee was employed under the TSS scheme for a minimum of three years at the appropriate salary.

Some of the criteria to be met by the nominator and the nominee are set out below:

  • Occupation must be on the MLTSSL
  • Minimum competent English
  • Be under 45 years of age at the time of application
  • May require a valid skills assessment
  • Three years’ experience (within the employer’s business, depending on the stream)
  • Meet character and health criteria

Temporary Skill Shortage visa (subclass 482)

You must have a minimum of two years of full-time employment in the sponsored role, a minimum of vocational English, good health, and be of good character as well. There may also be additional criteria to meet, depending on your nationality and the position you will be performing. You can include your spouse and children in this visa.

Skilled Work Regional (Provisional) visa (subclass 491)

This visa requires you to meet the points test and be nominated by a State or Territory or a family member living in a regional area.

Should you be nominated by a state or territory, you will be awarded 15 points.

You only need to achieve 50 points to reach the minimum requirement of 65 points.

The minimum criteria for the visa (subclass 491) is as follows:

  • Under 45 years of age
  • Competent English
  • Have an occupation on the relevant list
  • Have a valid skills assessment in the relevant occupation
  • Be nominated by a state or territory or sponsored by a family member
  • Satisfy the points test

If your 491 visa is approved, you will have a five-year work visa, which will only allow you to work live and study in the regional area. Once you have worked for three years and achieved a minimum earning of $53,900 annually, you will be eligible for the subclass 191 permanent visa. You can apply for the 491 anywhere in Australia except Sydney, Melbourne and Brisbane.

Skilled Employer Sponsored Regional (provisional) visa (subclass 494)

The visa (subclass 494) requires an employer in a region to sponsor you for a 5-year work visa. The occupation list is very extensive, with over 500 occupations to choose from.

The employer must lodge the following applications before visa lodgement:

  • Lodge RCB application with the local RDA
  • Lodge SBS application with the DHA
  • Lodge a nomination with the DHA
  • Some of the criteriabut the nominee is requried to have competent English, minimum three years’ experience in the occupation, a valid skills assessment, and be under 45 years’ of age
  • Similar to the subclass 491, the visa holder can apply for the subclass 191 permanent visa once they have worked in the nominating business in the nominating role for a minimum of three years. You can apply for the 494 anywhere in Australia except Sydney, Melbourne and Brisbane
